Terms of Service

Welcome to Zamitt Studio. These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client" or "You") and Zamitt Studio ("We," "Us," or "Our") regarding the use of our architectural visualization and real estate 3D rendering services. By engaging our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any of these provisions, you should refrain from using our services.

01. Scope of Services

Zamitt Studio specializes in high-quality architectural visualization, real estate rendering, and related digital media solutions. Our services include, but are not limited to, photorealistic 3D renderings, virtual tours, architectural animations, and conceptual visualizations. Each project is undertaken based on a mutually agreed scope, including deliverables, project timelines, and pricing. The Client is responsible for providing all necessary project materials, including CAD files, sketches, reference images, and any other specifications required to complete the work.

02. Project Engagement & Workflow:

All projects commence upon receipt of the Client’s brief and the necessary materials required for execution. The project timeline will be established based on the complexity and scope of work. Revisions are limited to the number specified in the initial agreement, and any additional modifications beyond this scope will be subject to additional charges. The final deliverables will be provided in the agreed format, such as JPEG, PNG, or MP4.

Clients must ensure that all provided materials are accurate and complete. Any delays caused by incomplete, incorrect, or late submission of materials by the Client may affect the agreed timeline, and Zamitt Studio shall not be held liable for any resulting delays.

03. Pricing, Payment Terms and Billing

The pricing for our services is determined based on project complexity, required deliverables, and deadlines. A 50% upfront payment is required before the commencement of work, with the remaining 50% due upon project completion and before the final files are delivered. All payments must be made via the designated payment methods specified in the project agreement.

Late payments may result in project suspension, and in such cases, Zamitt Studio reserves the right to withhold any final deliverables until full payment has been received. In the event of continued non-payment, Zamitt Studio may seek legal recourse to recover outstanding amounts.

04. Intellectual Property and Usage Rights

Unless otherwise agreed in writing, Zamitt Studio retains the full intellectual property rights over all renderings, animations, and other creative works produced. Upon full payment, the Client is granted a non-exclusive, non-transferable license to use the final renderings solely for the purposes specified in the agreement, including marketing, presentations, and promotional activities.

The resale, redistribution, modification, or use of our work for purposes not explicitly agreed upon is strictly prohibited. We reserve the right to showcase completed work in our portfolio, website, or promotional materials unless the Client has requested a Non-Disclosure Agreement (NDA) prior to project commencement.

05. Revisions and Modifications

Each project includes a set number of revisions, as outlined in the initial agreement. Revisions must fall within the scope of the original project specifications. Any significant modifications, such as changes to design elements, lighting, materials, or perspectives, beyond the agreed scope, may be subject to additional fees. The Client will be notified in advance of any extra costs incurred due to additional revision requests.

Once final deliverables are approved and delivered, Zamitt Studio is not obligated to make further modifications unless a new service agreement is established.

06. Confidentiality and Data Protection

Zamitt Studio respects the confidentiality of all Client-provided materials and project details. All data and information shared with us will be kept strictly confidential and will not be disclosed to third parties without prior written consent, except as required by law. If necessary, an NDA can be signed to ensure additional confidentiality protections.

We comply with all applicable General Data Protection Regulation (GDPR) policies regarding the collection, processing, and storage of Client data.

07. Cancellations and Refund Policy

Clients may request project cancellations; however, refunds will be subject to the stage of work completed at the time of cancellation. If a project is canceled before any work has begun, the Client may be eligible for a full refund. If the project has commenced, the deposit payment is non-refundable, as it covers the time and resources already allocated to the project.

Refunds will not be issued for completed projects or after final deliverables have been approved by the Client.

08. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Spain. In the event of any dispute arising from these Terms or the services provided, both parties agree to attempt to resolve the matter amicably through negotiation. If a resolution cannot be reached, the dispute shall be submitted to mediation or arbitration in Madrid before pursuing legal action.
